Zomba Magistrate court has convicted 35 year-old Billy Banda to
eight years imprisonment with hard labour for having anal sex
with a 13 year-old boy. Eastern Region Police Public Relations
Officer, Nicholas Gondwa said Banda was charged with sodomy
contrary to the penal code. Prosecutor superintendent, Dickens
Mwambazi, told the court on 8 July 2011, Banda from Tampira
Village, T/A Chikowi in Zomba District, met the boy on his way
to Matiya Primary School and persuaded him to go to his house.

Mwambazi added that from 17 July 2011, the boy was having anal
sex with Banda and was given K100 daily so that the boy should
not reveal the encounter.

It was also reported the boy's mother, Elizabeth Seven, searched
for him for a week and later found him at Banda's house after a
tip.

The boy revealed the matter which was reported to the police,
and Banda was arrested and charged with sodomy. In his
mitigation, the accused pleaded for forgiveness by the court
saying he had a wife and children to look after.

However, passing the judgment, Senior Resident Magistrate,
Thereza Chome, said the court had observed that the offence was
serious and dangerous in nature mainly to the victim who is a
child.

She also said the accused had a plan to commit the offence he
deserved a stiffer punishment in order to protect children from
people of such character. Banda was sentenced to eight years
imprisonment with hard labour.
